Terms of Service
These Terms of Service (“Terms”) govern your access to and use of Post-It, operated by Post-It (“Post-It,” “we,” “us,” or “our”). By creating an account or using the service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the service.
1. Agreement to these terms
These Terms form a binding agreement between you and Post-It. We may revise these Terms from time to time. Any revised version will be posted here with a new effective date. Your continued use of the service after the effective date means you accept the updated Terms.
2. Eligibility and account responsibility
You must be at least 18 years old or have the legal capacity to enter into a binding agreement in your jurisdiction. You agree to provide accurate account information, maintain the confidentiality of your password and authentication credentials, and be responsible for all activity that occurs under your account. Please notify us promptly at Hamilton@ham-x.online if you believe your account has been compromised.
3. The service
Post-It provides tools for drafting, saving, organizing, scheduling, and, where available, publishing content to supported third-party platforms. The service may change, be limited, or be temporarily unavailable at any time. Third-party platforms may impose their own rules, restrictions, or approval requirements; your use of those platforms remains subject to their terms and policies.
4. Your content and permissions
You retain ownership of content you submit to Post-It. By using the service, you grant us a limited, non-exclusive license to store, process, reproduce, transmit, and display that content solely to provide, secure, maintain, improve, and support the service and to publish it at your direction. You represent that you have all rights, permissions, and lawful bases needed to submit and publish the content.
5. Acceptable use
You may not use Post-It to violate applicable law or the rights of others, including copyright, trademark, privacy, publicity, or contractual rights. You may not distribute malware, send spam, impersonate another person, evade platform restrictions, access accounts without authorization, or interfere with the operation or security of the service. We may investigate suspected violations and suspend or terminate access where appropriate.
6. Billing, subscriptions, and cancellation
If Post-It offers paid features or subscriptions in the future, any such purchase will be subject to the pricing and billing terms presented at the time of purchase. You may cancel your subscription according to the applicable plan terms. We may suspend or stop access to paid features if billing is not completed or if a service is discontinued.
7. Administration and workspace access
Workspace administrators may manage access to accounts and content within their workspace. We may suspend, limit, or terminate access to protect the service, prevent abuse, or comply with legal requirements. Where feasible, we will provide notice of material account actions.
8. Intellectual property
Post-It and its software, branding, interface, and content are owned by Post-It or its licensors and are protected by copyright, trademark, and other intellectual property laws. Except for the limited right to use the service under these Terms, no rights are granted to you.
9. Disclaimers
The service is provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, and uninterrupted or error-free operation. We do not guarantee that any third-party platform will accept, display, or retain your content.
10. Limitation of liability and indemnity
To the fullest extent permitted by law, Post-It will not be liable for indirect, incidental, special, consequential, punitive, or exemplary damages, including loss of profits, business opportunities, data, goodwill, or reputation, arising from your use of the service. Our total liability for any claim arising from these Terms or the service will not exceed the amount you paid us for the service during the twelve months before the claim, or USD $100 if you paid nothing. You agree to indemnify and hold harmless Post-It and its officers, directors, employees, and agents from claims arising from your use of the service, your content, or your violation of these Terms.
11. Termination
We may suspend or terminate your access to the service at any time for conduct that violates these Terms, creates security or legal risk, or materially harms the service or other users. You may stop using the service at any time.
12. Governing law and dispute resolution
These Terms are governed by the laws of the United States and, to the extent applicable, the laws of the state in which Post-It is operated, without regard to conflict-of-law principles. If you are a resident of a jurisdiction with consumer-protection or dispute-resolution laws that provide additional rights, those rights remain available to you. 13. State-specific notices
If you are a resident of California, Colorado, Connecticut, Virginia, Utah, Nevada, or another state with applicable consumer privacy or digital-service laws, you may have additional rights or notice obligations.
